Does your Crisp chatbot break the EU AI Act?

From 2 August 2026, Article 50 of the EU AI Act requires that people interacting with an AI system are clearly told so — at the latest at the first interaction. If you run Crisp (Crisp AI bot / MagicReply) on a site with EU visitors, here's what that means for you.

Does Article 50 apply to Crisp?

Yes, if its AI features answer your visitors — and the disclosure is probably missing.

What Crisp does by default

Crisp does not switch on any Article 50 disclosure automatically. If you use Crisp's AI bot or MagicReply to answer visitors, the disclosure has to be configured by you — in the chatbox greeting and the bot's participant name/avatar.

How to make your Crisp chatbot compliant

  1. Set the Crisp chatbox greeting to an explicit “you're chatting with an AI assistant” message.
  2. Make the bot's name/avatar signal AI — not a human name with a photo.
  3. Publish an AI transparency page and add a persistent badge.
  4. Screenshot the first-interaction disclosure with a date.

The fine print

Non-compliance can be fined up to €15,000,000 or 3% of worldwide annual turnover (Art. 99(4)(g); for SMEs, the lower of the two). Enforcement by national authorities starts 2 August 2026. The June 2026 Digital Omnibus delayed many AI Act duties — but not this one. This page is implementation guidance, not legal advice.
