Does your HubSpot chatbot break the EU AI Act?

From 2 August 2026, Article 50 of the EU AI Act requires that people interacting with an AI system are clearly told so — at the latest at the first interaction. If you run HubSpot (Breeze customer agent / chatflows) on a site with EU visitors, here's what that means for you.

Yes, if its AI features are enabled — and you may need more than the default label.

What HubSpot does by default

HubSpot's Breeze shows a “Powered by AI” label in the chat header automatically. That's better than nothing, but a small header label on its own is borderline under the draft guidelines, which expect a clear notice at the first interaction — so most compliance guidance recommends adding an explicit AI first message on top of it.

How to make your HubSpot chatbot compliant

  1. In HubSpot: set your chatflow's welcome message to state it's an AI assistant.
  2. Keep the “Powered by AI” label visible in the widget.
  3. Add an AI transparency page linked from the widget.
  4. Keep dated evidence of both the label and the first message.

The fine print

Non-compliance can be fined up to €15,000,000 or 3% of worldwide annual turnover (Art. 99(4)(g); for SMEs, the lower of the two). Enforcement by national authorities starts 2 August 2026. The June 2026 Digital Omnibus delayed many AI Act duties — but not this one. This page is implementation guidance, not legal advice.
