Does your Smartsupp chatbot break the EU AI Act?
From 2 August 2026, Article 50 of the EU AI Act requires that people interacting with an AI system are clearly told so — at the latest at the first interaction. If you run Smartsupp (Mira AI) on a site with EU visitors, here's what that means for you.

Yes, if its AI features answer your visitors — and the disclosure is probably missing.
What Smartsupp does by default
Smartsupp is primarily live chat, with an optional AI assistant (Mira). If Mira is answering visitors, Article 50 applies — and Smartsupp does not add the disclosure for you. If only human agents use the widget, the chatbot disclosure duty doesn't apply (though other Article 50 duties still might).
How to make your Smartsupp chatbot compliant
- If Mira AI is enabled: set the bot's first message to state it's AI.
- Make sure the AI is distinguishable from your human agents.
- Add an AI transparency page and a persistent badge.
- Keep a dated screenshot for evidence.
The fine print
Non-compliance can be fined up to €15,000,000 or 3% of worldwide annual turnover (Art. 99(4)(g); for SMEs, the lower of the two). Enforcement by national authorities starts 2 August 2026. The June 2026 Digital Omnibus delayed many AI Act duties — but not this one. This page is implementation guidance, not legal advice.
