Does your Intercom chatbot break the EU AI Act?

From 2 August 2026, Article 50 of the EU AI Act requires that people interacting with an AI system are clearly told so — at the latest at the first interaction. If you run Intercom (Fin AI Agent) on a site with EU visitors, here's what that means for you.

Does Article 50 apply to Intercom?

Yes, if its AI features answer your visitors — and the disclosure is probably missing.

What Intercom does by default

Intercom can show an “AI Agent” label next to Fin, but it is a toggle — and for workspaces created after 10 July 2025 it is OFF by default. Intercom's own product terms state that customers are responsible for ensuring end users are informed they're interacting with AI. So if you switched Fin on and didn't change the disclosure setting, your visitors are likely not being told.

How to make your Intercom chatbot compliant

  1. In Intercom: Settings → AI Agent → turn on the AI Agent disclosure label.
  2. Set Fin's intro message to explicitly say it's an AI assistant (not just a name).
  3. Add a persistent AI indicator near the launcher and a public AI transparency page.
  4. Keep a dated screenshot of the disclosure as evidence.

The fine print

Non-compliance can be fined up to €15,000,000 or 3% of worldwide annual turnover (Art. 99(4)(g); for SMEs, the lower of the two). Enforcement by national authorities starts 2 August 2026. The June 2026 Digital Omnibus delayed many AI Act duties — but not this one. This page is implementation guidance, not legal advice.
