Does your Gorgias chatbot break the EU AI Act?
From 2 August 2026, Article 50 of the EU AI Act requires that people interacting with an AI system are clearly told so — at the latest at the first interaction. If you run Gorgias (Gorgias AI Agent) on a site with EU visitors, here's what that means for you.

What Gorgias does by default
Gorgias's AI Agent answers shopper questions automatically. When it's live, Article 50 requires visitors to be told they're dealing with AI — and that disclosure isn't switched on for you by default.
How to make your Gorgias chatbot compliant
- In Gorgias: set the AI Agent's opening message to state it's an AI assistant.
- Ensure the AI is presented distinctly from human support.
- Publish an AI transparency page and add a badge.
- Save a dated screenshot of the disclosure.
The fine print
Non-compliance can be fined up to €15,000,000 or 3% of worldwide annual turnover (Art. 99(4)(g); for SMEs, the lower of the two). Enforcement by national authorities starts 2 August 2026. The June 2026 Digital Omnibus delayed many AI Act duties — but not this one. This page is implementation guidance, not legal advice.
